Terms of Service

These Terms of Service (“Terms”) govern your access to and use of refrigimart.com and any order you place with RefrigiMart LLC (“RefrigiMart”, “we”, “us”). By using this site or placing an order you accept these Terms. If you do not accept them, do not use the site.

We sell regulated products to a regulated audience. Several clauses below exist because federal law requires them, not because we chose to be difficult — those clauses are not negotiable.

1. Eligibility to purchase

You must be at least 18 years old and able to form a binding contract. You must provide accurate, current and complete information at checkout and keep it current.

Refrigerant sales in the United States are restricted. To buy refrigerant from us you must be one of the following, and you must be able to prove it:

• A technician certified under EPA Section 608 (Type I, II, III or Universal) for stationary equipment;
• A technician certified under EPA Section 609 where the refrigerant is for motor-vehicle air conditioning;
• The employer of such a technician, purchasing for that technician’s use;
• A reseller who will sell only to the parties above and who has supplied a valid resale certificate;
• A purchaser who otherwise qualifies under an exemption in 40 CFR Part 82.

Confirming your certification status at checkout is a representation you make to us. Making a false representation to obtain a restricted product may expose you to liability under federal law, and it terminates your right to use this site immediately.

2. Order acceptance and verification

Your order is an offer to buy. No contract exists until we accept the order by dispatching the goods. Placing an order and receiving an automated confirmation email is not acceptance.

Every refrigerant order is held for certification review before dispatch. If we cannot verify your eligibility, we will contact you for documentation. If it is not supplied, or if it does not qualify, we will cancel the order and refund you in full. We may do this at any point before dispatch.

We may also decline or limit an order where we suspect fraud, where quantities are inconsistent with legitimate service use, where the delivery destination is one we cannot lawfully ship to, or where a listing contained a pricing or description error.

3. Professional use only

Everything we sell is intended for use by trained, appropriately certified professionals in the course of servicing equipment designed for that refrigerant. It is not a consumer product.

You are solely responsible for selecting the correct refrigerant for the equipment you service, for following the equipment manufacturer’s instructions and the safety data sheet, for using appropriately rated tools, and for complying with every federal, state and local requirement that applies to your work.

4. Pricing, taxes and payment

Prices are shown in US dollars and exclude sales tax, which is calculated at checkout where we are required to collect it. Our current catalogue price is $99.94 per cylinder; the comparison figure shown alongside it is a reference to typical distributor list pricing, not a price we previously charged.

We may change prices at any time. The price that applies to your order is the price displayed when you complete checkout.

Payment is taken at the time of order. If a listing contains an obvious error — a price plainly inconsistent with the product — we may cancel the affected order and refund you rather than honour the error, whether or not the order has been confirmed.

5. Shipping and risk

We ship ground only, within the contiguous United States. Delivery estimates are estimates. Full detail is in our Shipping Policy, which forms part of these Terms.

Title and risk of loss pass to you on delivery by the carrier. Where a shipment is lost or damaged in transit, we will pursue the carrier claim and either replace or refund the affected goods, provided you notify us within the time limits set out in the Shipping Policy.

6. Returns

Unopened cylinders may be returned within 14 days of delivery under our Refund Policy. Opened or used cylinders cannot be returned, for safety and regulatory reasons.

Do not ship any cylinder back to us without a written return authorisation. Refrigerant cylinders are regulated hazardous materials in transport and returning one without correct packaging, marking and documentation may be unlawful.

7. Intellectual property

The design, text, graphics, product illustrations, layout and code of this site are owned by RefrigiMart LLC or licensed to us, and are protected by copyright and other intellectual property laws. Refrigerant designations such as R-410A and trademarks belonging to equipment or chemical manufacturers remain the property of their respective owners; we use them descriptively to identify products, and their use here does not imply affiliation or endorsement.

You may view, download and print pages from this site for your own internal business use. You may not reproduce, republish, sell or systematically extract any part of it without our written permission.

8. Acceptable use

You agree not to use this site to break the law, to misrepresent your certification status, to interfere with the site’s operation or security, to scrape or harvest data by automated means, or to resell products in a way that breaches the restrictions in 40 CFR Part 82.

9. Warranties and disclaimers

We warrant that the products we supply are as described, are of the stated composition and net weight, and are supplied in cylinders that were sealed and undamaged when they left us.

Beyond that, and to the fullest extent permitted by law, products and this site are supplied “as is” without any other warranty, express or implied, including implied warranties of merchantability or fitness for a particular purpose. We do not warrant that any product is suitable for a particular system — that determination is yours.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount you paid for the products giving rise to the claim.

We are not liable for indirect or consequential loss, including loss of profit, loss of business, equipment damage arising from incorrect refrigerant selection or improper service, refrigerant loss from a system fault, or costs of downtime.

11. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, from any misrepresentation of your certification status, or from your handling, use, storage, transport or disposal of products after delivery.

12. Changes to these Terms

We may update these Terms from time to time. The version in force is the one published on this page at the moment you place an order, and the “last updated” date above tells you when it changed. Material changes will be flagged on the site.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas and the federal laws of the United States, without regard to conflict-of-law rules. The state and federal courts located in Tarrant County, Texas have exclusive jurisdiction, and both parties submit to that jurisdiction.

Before starting proceedings, both sides agree to attempt in good faith to resolve the dispute by writing to the other with the details and allowing 30 days for a response. Most problems are solved by an email and a phone call.

14. General

If any provision is held unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between us regarding your use of the site and your orders.
